TERMS AND CONDITIONS

The use of the website www.sunnycharter.it and the booking of the boat charter services offered by RUSSO LUCA are governed by the following Terms and Conditions of Sale. By making a booking, the user  accepts these conditions in full and without reservation.

1. Object of the Contract

This contract governs the booking and purchase of boat charter services offered on the Site. The contract is concluded between the Customer and RUSSO LUCA, with the sale and management of the booking carried out via the external payment platform Stripe, which guarantees secure payment processing.

The Customer reads and accepts that the sale and execution of the Services are also subject to the terms and conditions of use of the External Service, which can be consulted at the following link.

2. Booking and Payment Methods

Reservation:
Bookings of the Services are made exclusively online through the Site. During the booking process, the Customer will be able to select, from the available options, the desired departure port among those located along the coasts of Sorrento and Amalfi, including the island of Capri. Port availability may vary and will be indicated during the booking process.
Payment:
Payment for the Services takes place via the External Service, which guarantees the security of the transactions. The prices of the Services are expressed in Euros and are inclusive of VAT and any other applicable taxes, unless otherwise specified.

3. Cancellations and Modifications

Cancellation Policy:
The Customer has the right to cancel the booking without any penalty within 14 days from the booking date, if the booking was made remotely or outside the commercial premises, and in any case up to 72 hours before the scheduled start time of the Service.
Beyond this 72 hour deadline, in the event of cancellation by the Customer, the following conditions will apply:

• For cancellations communicated between 72 and 24 hours before the start of the Service, 25% of the total amount will be retained as a penalty.
• For cancellations communicated within 24 hours before the start of the Service, or in case of no-show, 100% of the total amount will be retained.

Refund in case of Adverse Weather Conditions:

In the event of weather conditions that make the performance of the Service objectively dangerous or impossible (for example, weather warnings issued by the Civil Protection, storm surges such as to prevent navigation assessed by the competent maritime authorities), the Owner reserves the right to cancel the Service in order to guarantee the safety of Customers and staff.

In this case, the Customer will have the right alternatively to:

• Full refund of the amount paid; or
• Rescheduling of the Service on an alternative date, to be agreed with the Customer based on availability.

The decision regarding the existence of adverse weather conditions and the possible cancellation of the Service lies with the Owner, who undertakes to promptly communicate the decision and the available options to the Customer.

Cancellation for other reasons:

Except for the cases expressly provided for in this article (cancellation within the deadline or due to adverse weather conditions), no refunds will be provided for cancellations due to personal reasons of the Customer. However, the Customer may request to evaluate the possibility of changing the date of the Service, based on availability and subject to any price addition if the alternative Service chosen has a higher cost. The decision regarding changing the date remains at the discretion of the Owner.

4. Information about the Service

Pre-Departure Instructions:

The day before the Service, the Customer will receive via email, at the address indicated during the booking phase, complete information relating to the address and exact location of the selected port of departure, together with the useful contacts of the assistance staff.
The Owner’s staff will be present at the port of departure to welcome the Customer and provide all the necessary information.

Departure Place:

The boat charter services depart from the ports located along the coasts of Sorrento and Amalfi, including the island of Capri, which can be selected at the time of booking based on availability. The final port of departure will be confirmed in the booking summary email and in the pre-departure instructions.

5. Responsibility

Force Majeure:

RUSSO LUCA will not be responsible for failures or delays in the execution of the Service, nor for direct or indirect damages that may arise to the Customer, if such failures, delays or damages are caused by events of force majeure or unforeseeable circumstances, such as, by way of example and not limited to: natural disasters, adverse weather conditions as defined in the art. 3, strikes, provisions of public authorities, accidents or other unforeseeable and extraordinary events which prevent or make objectively dangerous the performance of the Service.

Limitation of Liability:

Without prejudice to the commitment to provide high quality Services, RUSSO LUCA will not be responsible for disservices or malfunctions directly attributable and unforeseeable to the External Service limited to the processing of secure payments, nor for actions or omissions of truly independent third parties and beyond the reasonable control of the Owner.

In any case, RUSSO LUCA‘s liability for any direct damages resulting from failure to fulfill contractual obligations will be limited to the maximum total amount paid by the Customer for the booked Service. In any case, liability for indirect, consequential damages or lost profits remains excluded.

6. Final Provisions

Applicable Law:

These Terms and Conditions are governed by Italian law.

Competent Court:

For any dispute relating to the interpretation, execution or validity of the contract, the court provided for by law will be competent.

Changes to the Terms:

RUSSO LUCA reserves the right to modify these Terms and Conditions at any time, for regulatory adjustments, modifications to the Services offered or for other legitimate reasons. The changes will be published on the Site and, in the event of substantial changes that significantly affect the rights of the Customer, the latter will be informed with adequate notice via email to the address provided during the booking and/or publication of a clearly visible notice on the Site for at least 30 days. Use of the Service following the publication of changes constitutes acceptance of them.

Privacy and Data Processing:

The processing of personal data takes place in accordance with the [Information on the Processing of Personal Data] (https://www.sunnycharter.it/privacy-policy/), which the Customer is invited to consult in full to learn about their rights and methods of managing personal data.

By accessing and using the Site and booking our Services, the Customer declares to have read, understood and fully accepted these Terms and Conditions of Sale.
